Police await test results in Sparta bar death

SPARTA — Authorities still need toxicology test results on a Sparta man who died Christmas Eve after an altercation at a bar before deciding whether to seek criminal charges in the case.

The autopsy report on David Endres, 67, can’t be completed without those test results, which are expected any time, said Monroe County District Attorney Dan Cary.

Endres’ brother, 65-year-old Mike Endres of Sparta, said he hopes charges are filed and the family can get some answers.

“It’s hard all the time,” he said of his older brother’s death.

David Endres died at Gundersen Lutheran Medical Center after an incident at Dimensions Bar in downtown Sparta, said Sparta Police Chief Michael Kass. Police are investigating how Endres was injured.

Dimensions’ owner Pat Murphy believes the incident is one of the reasons why Kass opposed renewing the establishment’s liquor license. The City Council failed to renew the license May 20 on a 2-6 vote. The bar will be unable to serve alcohol effective June 30. Murphy’s attorney filed an appeal Tuesday in Monroe County Circuit Court seeking to reverse the decision. A hearing is expected in June.

“We want our license renewed and to be treated like everyone else,” Murphy said.

City Administrator Ken Witt said the renewal request was denied because of the high number of calls to the establishment and the bar’s response to past incidents. Disturbances are pushed outside, Witt said, rather than being handled internally.

“They weren’t dealing with the situation, they were just pushing it away,” Witt said.

Murphy’s brother and bar manager Scott Murphy filed a harassment complaint against Kass with the police department last week and the city Tuesday. The police department forwarded the complaint to the Monroe County Sheriff’s Department to avoid conflict of interest.

The complaint claims Kass told Pat Murphy he did not approve of the liquor license when the business was purchased in May 2007 because Scott Murphy, then a co-owner, was a felon who was convicted in 1988 of passing worthless checks.

Kass’ reasoning was discriminatory because the denial of a liquor license based on a person’s conviction record must include an alcohol-related felony, Scott Murphy said.

“I have to get him ticketed first for harassment or discrimination, then I’ll file a monetary lawsuit,” Scott Murphy said.

The liquor license renewal was denied after Kass told the council Dimensions’ was “riotous and disorderly,” Scott Murphy said. He thinks the renewal denial is a “direct harassment against me and my job,” according to the complaint.

“Obviously Mr. (Scott) Murphy is upset the council chose not to renew the license and appears to be making me the target of his dislike for the city taking away his brother’s liquor license,” Kass said.

" Nice stab but the article also mentions a death!! Yes, close ALL the bars....then maybe Tomah would be a better community to live. There has ALWAYS been way too many bars for such a small area. They should limit the number of liquor license issued in each county/state. That would be a vast improvement over all, not just closing one bar. "

The real problem is that Tomah (and Sparta) keep allowing bars who have track records of multiple nightly police calls, frequent fights and suspicion of drug sales and use to still get bar licenses. At some point, the city needs to stop letting this go on and clean up this town. Until that happens, downtown Tomah will be an unsafe place at night. That's a horrible reputation for a city of less than 10,000.

We could have a fantastic city that would lure the thousands of people who stay at Jellystone and pump some much needed cash and jobs into the economy if we weren't known as a town with numerous bars and drunks who urinate and fight in public along our main street.

It's time to start getting more mainstream businesses into our city and get rid of the smokefilled, nauseating bars who keep Tomah police busy dragging in people who's main contribution to society is getting drunk and selling drugs. "

" yes it may temporarily move the trouble from one bar to the next but its the same trouble makers that go from bar to bar. Once the bar owners take a stand and not serve the trouble makers then the problem will begin to be resolved. Tomah is trying and most of the bar owners are on board. Keep up the good work!!! "

I'm more concerned about the death and why it is taking so long for them to get answer's to the family and some closure to them. " Closing the bars just moves the crowd to a different bar. The point is that this murder has not been solved and the family has not had closure of the real problem, a death that occured outside of the bar....has nothing to do with the bar but how the Monroe County police and DA handle these types of situations. Toxicology/autopsies do not take 6 months.....People should be more concerned about the death and the legal process to find the person responsible for this poor man's death. Maybe it's time for a new DA that will work on the harder cases to arrest people for these types of crimes rather than pulling people over for minor offenses to get money for the county.....murders/deaths need to be taken seriously and those responsible arrested, which of course costs the county money where minor infractions of the law provide them money. "

" I for one have to agree with city council on this one. Both bars, the one here in Tomah and the one in Sparta are nothing but a place for trouble. On any given night all you have to do is drive by and you see the police outside his bars trying to keep people from fighting. They both need to be shut down and not allowed to reopen again. There are more underage kids in these bars and the drugs flow like water in and around both places.
So, please do both towns a favor and dont renew either one of them. "
