Federal lawsuit alleges sexual misconduct in Monroe County jail

MADISON — Barely a year after Monroe County’s insurer agreed to pay up to $13.1 million to settle allegations that a jailer sexually abused an inmate, a second suit has been filed in federal court alleging the same jailer sexually abused another psychology frail inmate.

The suit filed last week alleges that in 2001-02, former jail night shift supervisor Lt. David Schaldach had oral sex repeatedly performed on him by a female inmate who a jail nurse had recommended be placed on suicide watch. Schaldach warned the inmate not to discuss the sexual abuse with anyone or he would “come see her again,” according to the complaint.

“The suicide watch recommendation was written right on her (jail) records, and we believe Schaldach ignored it hoping she would commit suicide,” said La Crosse attorney Michael Devanie, whose client’s identity is being withheld because she is a possible victim of sexual assault.

In a deposition taken in 2006 in the suit that resulted in the $13.1 million settlement, Schaldach admitted to having the plaintiff perform oral sex on him in 2002 in a conference room at the jail.

Schaldach was charged earlier this year in Monroe County Circuit Court with one count of abuse and neglect of inmates in 2002. His plea and sentencing hearing is scheduled for April 17.

The plaintiff’s mental health deteriorated while she was in jail, Devanie said.

“She went in for relatively insignificant offenses but was sent to Winnebago Mental Health Institution for two years as her condition worsened in jail,” Devanie said. “I think it’s apparent that Schaldach targeted people under psychiatric care for this abuse.”

Although the county’s insurer, Wisconsin County Mutual, knew about the plaintiff’s allegations against Schaldach when it was settling the previous suit, it never made a reasonable settlement offer, Devanie said.

The suit names Schaldach, then-Sheriff Charles Amundson and then-Undersheriff John Cram as defendants, and seeks unspecified damages.

Monroe Corporation Counsel Kelly Sullivan Flock could not be reached for comment.

Current Monroe County Sheriff Dennis Pedersen said unlike Schaldach, his jail administrator and top administrators are all state-certified jailers.

" This does not surprise me. The unfaithfulness & dispicable behavior, by not only the jailers, but dispatchers & officers is wrong. The whole of the Monroe County Sheriff's Dept. needs to be "cleaned up" before the county goes broke settling lawsuits by those who suffered an injustice under the "watchful" eyes of the law. If this is the types of characters working to protect us & our rights - GOD help us. And there should be more held repsonsible than just Shaldach. What a man - to take advantage of the mentally unstable. Makes you wonder what else that piece of trash has done. I hope you burn in H--- for what you have done!!!!!!!! "

" There has been rumors of this kind of activity for years in the county Jail, I just never could believe it. I never went to Jail and just thought all criminals were liars(kinda like politicians)

Now it makes me wonder about the other rumors over the past 30 years I have heard.

You would think Someone should have run the Jail and been more responsible, hopefully this has been corrected now,time will tell

But yes more heads should ROLL, the more a person thinks about this, the more upset they tend to get because, there is NO WAY this was a one time event

Just like the abuse in the VA a few years back, a lot of Rumors and then pop someone got busted. "

" If this is the case there better be more heads on the platter than just Schaldach's .People had to know this was going on the Monroe County Jail isn't that big. How much can we afford to pay for the misconduct of many at the jail house?? The insurance company maybe paying the bil for the lawsuits but we will pay the premiums for the lawsuits. I think it is time we bring in private investigators find out what the heck was gonig on in the jail house take the appropriate action against all involved. Amundson nor Cram should get out of this if they knew about this sickness Schaldach had..Bring in the FBI before anymore lawsuits are filed!!! "
