Lawsuit filed against County Zoning Committee

Attorney Glenn Stoddard, representing William Semann, of Norwalk, WI, and Myron Brueggeman, of Chicago, IL, filed a lawsuit Tuesday against the Monroe County Planning and Zoning Committee. The lawsuit alleges the construction of industrial scale wind towers would affect health and safety, and interfere with a private airstrip owned by Brueggeman.

“If developed and operated as approved under the CUP, the Summit Ridge wind energy project will adversely affect Semann’s health and safety (from excessive noise, debris throw, and other impacts), substantially and unreasonably interfere with the use and enjoyment of Semann’s property, and substantially interfere with and take without just compensation Semann’s property rights, including but not limited to his air rights and development rights,” wrote Attorney Stoddard in the suit.

Plaintiff Brueggeman, an Illinois resident, owns 300 acres of land where he has a conditional use permit for a private airstrip. The complaint alleges that the construction of an unspecified number of wind towers would adversely affect his ability to develop the airstrip as well as his health and safety. Both parties own property in the town of Wells, which did not veto the conditional use permit (CUP) granted to Summit Ridge Energy to construct wind towers.

The lawsuit claims that the Planning and Zoning Committee proceeded on an incorrect theory of law and violated plaintiffs’ rights when it approved an incomplete conditional use permit. The committee also violated their rights when it allowed Summit Ridge to have input in its deliberations and decision after the close of the public hearing, as well as using Summit Ridge’s “findings” for the conditional use permit, according to the complaint.

The suit further alleges that the committee “acted arbitrarily and unreasonably and did not base its decision on the evidence.” It also did not discuss any public testimony or evidence. Lastly, the complaint says the committee based its views on the Montfort wind farm, a much smaller facility, at the request of Summit Ridge Energy and the Fond du Lac County conditional use permit, but did not set forth any factual findings.

The Monroe County Planning and Zoning Committee said it could not comment on the lawsuit, but that it would be handled by its legal counsel.

The Town of Ridgeville previously vetoed the conditional use permit for Summit Ridge Energy to build wind turbines in its municipality. The Monroe County Planning and Zoning Committee will now meet at 9 a.m. June 5 at the Monroe County Courthouse, where it is expected to make a decision in granting Summit Ridge Energy a conditional use permit to build wind turbines in the town of Wilton.

" Ridgeville landowner in favor: Please explain to me why the Monroe County Highway department (A tax payer funded entity) has spent several days clearing private land on County U that is not part of the easement to the highway? Seems to me that taxpayer dollars are already being spent frivilously. Also, of course youre going to be in favor of the project, you probably will get paid by Invenergy. You know that you could make more money off corn being sold to an ethanol plant than these small checks you're going to get from the energy company? P.T. Barmnum was qouted once as saying, "There's a sucker born every minute." "

" This is ridiculous! Mr. Myron Brueggeman, please go back to Chicago and take the ridgeville landowners who are opposed to the turbines with you so we can move forward on the wind turbine project. The opponents have no proof of their allegations. All this frivilous lawsuit will do is cost the Monroe County taxpayers money that could be better spent elsewhere. Thanks for wasting the hard-earned tax payer dollars. "

" Those who oppose the wind farms have no proven facts in their claims of interference with their health and well being. This boils down to a land owner with a never ending pocket book paying a big-shot lawyer and another individual to do nothing but stop the project and to twist the facts in their favor to rail road the project. I am a Ridgeville land owner in favor of the project. Quit wasting the tax payer's money on frivilous lawsuits. What excessive noise are you referring too. Have you taken the time to go to any of the current tower locations? A train going through Sparta makes more noise than a wind turbine. Yes, this is a joke. Take the ridgeville resident with you (to Chicago) who are opposed to the wind turbines. They are only stifling the project. "

" WHy haven't the people of the area found some way to file against this man? Maybe his airstrip is noise pollution to them. Maybe his claims are frivolous and are causing financial hardship for the citizens of the area who live there full time. Get creative he sure has. "

" Welcome to one of the most unique places in the United States of America. This is the center of the coulee region. Sometimes refered to as the Driftless area (The area in which the last glacier didn't touch) Here we have some of the rarest species of plants and animals in the world. Endangered species here include Northern Monkshood, Chrysosplenium iowense and many others. There has been several significant archeological finds in this area. Paleo Indian Relics, drawings, hyroglythics, Prehistoric fossils, skeletal remains of wooly mammoths, etc. And a major archeological site is located just a few miles from where they want to place these towers. It's a shame that a out of state company and a few greedy landowners want to destory this pristine land for the benefit of a few extra dollars in their pockets. A Chicago based company will profit, a few landowners will profit, the rest of us will get no breaks, The state of Wisconsin wants 10% renewable energy by 2015, Thats not going to happen in this case, The company that plans on erecting these towers, plan on selling the energy to a small town in illinois. So therefore, we don't get any tax breaks on this one people. Just big ugly towers that dont fit into the natural beauty of this area. "

" Here's another hot shot, absentee landowner from out of State trying to show the country bumpkins how its done in the City. The County should condemn his land on the basis of "eminent domain" and take what they need from him to make sure this project gets completed. We need viable alternative energy sources more than we need a private airstrip. "
